WOMEN in the workplace AFTER MATERNITY LEAVE

Question: The Basic Conditions of Employment Act (BCEA) is complimented with a vast range of CODES OF GOOD PRACTICE. Are these codes compulsory? Can the employer focus on the BCEA and the LRA only?

Answer: The codes is indeed a legal requirement. All employers must comply.

Example: Code extract 5.13 states: "Arrangements should be made for employees who are breast-feeding to have breaks of 30 minutes twice per day for breast-feeding or expressing milk each working day for the first six months of the child's life."  The employer must implement the code, keeping in mind the lunch and tea break arrangements that may already be in place.
