Can an employee be dismissed for OUT-OF-OFFICE MISCONDUCT?

Although employees can be dismissed for misconduct outside the workplace, it is not quite straightforward.

Can you show there is a link between the company or operational requirements and the misconduct? Can you prove negative consequences to the company as a result of the misconduct outside the workplace, e.g. loss of clients?Have you hold a disciplinary hearing before dismissal? Is it stated in your disciplinary code that employees can be dismissed for misconduct outside the workplace? Was it explained to the employee in the induction programme that actions outside the workplace negatively affecting the company will result in dismissal?
You can dismiss an employee for misconduct outside the workplace subject to there being a connection between his/her misconduct and the company.
